NimiTV Infringement and DMCA Policy

Claims Regarding Infringement or Other Illegal Content

Pursuant to the United States Digital Millennium Copyright Act (17 U.S.C. §512) (the “DMCA”), NimiTV (“the Company”) has implemented procedures for receiving written notification of (a) claimed copyright infringement, (b) claimed violations of other intellectual property rights, or (c) content that is otherwise alleged to be illegal. The steps required to submit a notice are outlined below and vary depending on the nature of your claim.

Please note: NimiTV operates as a content distributor and platform provider, delivering live TV and on-demand content to its users. Some content may originate from third-party content providers or channels. NimiTV reserves the right to terminate services for providers or partners that violate our policies, including copyright or intellectual property rights.

Depending on the nature of the content delivered via the Company, NimiTV may rely on protections provided under Sections 512(a) and/or 512(b) of the DMCA, which limit liability for intermediaries who serve only as conduits or cache providers of third-party content. Specifically:

  • All transmission of third-party content is initiated by external content providers or users.
  • NimiTV does not alter the content or influence the recipient.
  • NimiTV complies with industry-standard data transmission protocols.
  • NimiTV’s infrastructure ensures content is delivered as intended by the content owner, without interference or unauthorized modification.

 

A. Claimed Copyright Infringement

1. Notice of Alleged Infringement

If you believe in good faith that your copyright-protected work has been used or displayed through NimiTV’s services without proper authorization, you may submit a written DMCA notice. The notice must contain the following:

  • (a) Your physical or electronic signature;
  • (b) A description of the copyrighted work you claim has been infringed;
  • (c) The exact location (e.g., URL or channel name) of the allegedly infringing material;
  • (d) Your full name, phone number, and email address;
  • (e) A statement that you have a good faith belief that the use of the material is unauthorized by the copyright owner, its agent, or the law;
  • (f) A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on their behalf.

Upon receiving a valid notice, NimiTV may:

  • Remove or disable access to the content (if under our control), or suspend/terminate services of the infringing party;
  • Forward the notice to the responsible content provider;
  • Notify the content provider of the removal and their right to file a counter-notice.

 

2. Counter-Notice

If you are a content provider and believe your content was removed or your access was disabled in error, you may submit a counter-notice. It must include:

  • (a) Your physical or electronic signature;
  • (b) Identification of the removed or disabled content;
  • (c) A statement under penalty of perjury that you believe the content was mistakenly removed or misidentified;
  • (d) Your name, address, phone number, and a statement consenting to the jurisdiction of the U.S. District Court for the Southern District of New York (or your local district if in the U.S.), and that you will accept service of process from the original complainant.

Upon receipt, NimiTV may:

  • Forward your counter-notice to the complainant;
  • Restore the content within 10 business days unless the complainant initiates legal action.

 

 

B. Violation of Other Rights or Illegal Content

If you believe any content distributed by NimiTV is illegal (e.g., trademark infringement, defamation), please provide:

  • A detailed explanation of the alleged illegal or infringing content and why it is unlawful;
  • The location (URL, channel, timestamp) of the material;
  • Your name, address, email, and phone number.

NimiTV will evaluate the claim and may remove content, terminate accounts, or forward your notice to the relevant party.

 

 

C. Repeat Infringement Policy

NimiTV maintains a strict policy against repeated infringement. Accounts found to be repeatedly violating intellectual property rights may be suspended or terminated at NimiTV’s sole discretion.
